Ex-deputy: OCU seized the UOC-KP’s property and may be liquidated

Former deputy Sergei Melnichuk spoke about the raider seizure of the UOC-KP during the creation of the OCU. He wrote about the facts of violation of the law during the liquidation of the Kyiv Patriarchate on his Facebook page.
Melnichuk cited several facts of violations and forgery of documents during the registration of the OCU:
- During the liquidation of the UOC-KP, Filaret signed a document on the termination of the activities of his "church" after the creation and registration of the religious organization "Metropolis of the UOC". As you know, the new structure is registered as the "Kyiv Metropolis of the UOC (OCU)". Thus, formally, the Ministry of Culture did not have the right to liquidate the UOC-KP, and the created organization has no rights to the property of the Kyiv Patriarchate.
- In Ukraine, there is no original text of the "local council" at which the OCU was created – it is kept by the head of Phanar. But without the original, the state registrar has no right to make changes.
- According to the law, the decision to terminate the activities of legal entities can be cancelled, which was done by Filaret on June 20, 2019. However, the Ministry of Culture did not recognize this cancellation.
- The Ministry of Culture made a record in the state register about the termination of the activities of the UOC-KP through reorganization; this allowed the OCU to inherit the rights of the Kyiv Patriarchate. But at the same time, a commission for liquidation was created, although they should have created a commission for reorganization. In addition, this commission was created by another religious organization (OCU) and did not include representatives of the UOC-KP.
The ex-deputy believes that the UOC-KP was seized for the appropriation of property and participation in political processes in favor of Poroshenko. At the same time, the administrative resource was used and the OCU was registered in violation of the law.
“By illegally encroaching on the property of the UOC-KP, the OCU can be liquidated as a church that incites sectarian enmity and is simply outlawed,” Melnichuk wrote. “At the same time, the illegally created organization carries out its activities contrary to the Constitution of Ukraine, interferes in the executive branch of government and takes part in an active political struggle in favor of one of the political forces.”
“The church is a bridge between man and God, rather than an agitator of the flock in favor of one person,” the ex-deputy summed up.
Earlier, the UOJ wrote about the statement of the UOC-KP lawyer that the court “lost” the case on the registration of the Kyiv Patriarchate.
