On June 27, 2024, a court session was held at the Northern Appellate Commercial Court of Kyiv regarding the termination of the agreement for the brethren's use of the premises of the Lower Lavra. The UOC lawyer, Archpriest Nikita Chekman, reported on his Telegram channel that the hearings were postponed.
During the court session, the lawyers of the Kyiv-Pechersk Lavra filed a motion for the recusal of Judge Havryliuk due to his bias. In his texts, the judge made inappropriate remarks towards the UOC and showed sympathy for the OCU. The defense substantiated their argument with evidence of his publications. It is noted that the judge is also involved in teaching activities.
As a result of the consideration of the motion, the panel of judges denied the recusal, but Judge Havryliuk recused himself.
It is reported that a new panel of judges will be formed. The date of the next session will be announced later.
As the UOJ reported, the composition of the panel of judges for this case has already been completely changed earlier.
